End of Birthright Citizenship in the US
President Donald Trump intends to sign an executive order banning the constitutional right of Jus Soli. Jus Soli is Latin for “Right of the Soil”. It is a term that is synonymous with the definitions of citizenship grants in countries around the globe. Section 1 of the Fourteenth Amendment to the constitution act of the United States of America states that “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside”. A person who is born on the soil of the United States of America is an American Citizen by the right of the soil “Jus Soli”.
Legal Mechanism to End Birthright citizenship in the US
If the executive order is signed, a mother who is foreign to the United States and who gives birth to a child on American soil will no longer enjoy the privilege of having her child obtain American citizenship. President Trump has also said that he is contemplating getting congress involved to approve his proposition; An executive order will be much faster though.
The motion has faced criticism and is being challenged by members of the G.O.P. Paul D. Rayan, the speaker of the house has said that an executive order cannot eviscerate birthright citizenship.
The United States has always been concerned with the growing population of illegal immigrants. The just logic behind this proposed executive order is to limit the number of citizenships granted to children of illegal immigrants in the United States.
